Every Head of Administrative Department of the State Govt. is Competent Authority under this Act. As per Sec. 5(1), every Competent authority shall for the purposes of this Act, designate one or more officers as Public Information Officers in all Administrative units and offices under such authority.Divisional Commissioner, Nashik Div. Nashik is the Appellate authority U/s. 2(1) and 2(3) of the Act. The list of ‘Public Information Officers’ in the office of Divisional Commissioner, Nashik Division, Nashik is as follows.
In every Collectorate of Nashik Div. ‘ Appellate Authority ’ as well as ‘Public Information Officers ’ have been appointed by the Collectors of Nashik Division. Divisional level Council consisting of 6 non – official members under the Chairmanship of Divisional Commissioner has been set up ; U/s. 13 of the said Act. It is as follows.
There are quarterly meetings of this Council. Various issues about right to information are discussed & the suggestions are being sent to Govt. (1) The Arms Act 1959 At District Level, ‘ District Magistrate ’ is empowered to grant Arms license under the provisions of Arms Act 1959. U/s.18 of the said Act, Any person aggrieved by an order of the licensing authority refusing to grant a license or varying the conditions of a license may prefer an appeal within 30 days from the date of order to the Divisional Commissioner. (2) Petroleum Act 1934 U/s. 155 of the Petroleum Act 1934, an appeal shall lie against any order to grant, amend or renew a license canceling or suspending licenses, before the Divisional Commissioner; ( the immediate official Superior to the District Authority, if the order passed by the District Authority ). The time limit for filing the appeal is 30 days from the date of the Order. (3) Eating house license Appeals under the provisions of Bombay Public Entertainment Establishments Act and Bombay Police Act against the order passed by the District Magistrate lies to Divisional Commissioner.The time limit for filing the appeal is 30 days from the date of the order. (4) Prisons ( Bombay Furlough and Parole ) Rules 1959 Under rule 18, the Divisional Commissioner of the Division is competent to sanction parole leave ( 30 days upto 90 days ) to the convict. However, a prisoner may be released on parole for such period not exceeding thirty days at a time. Regional Transport Authority The State Government under powers as per Section 68 of the Motor Vehicles Act 1988, by notification constitutes a Committee of Regional Transport Authority under the chairmanship of the Divisional Commissioner.The Regional Transport Authority, Nashik came into force in 1981.
Functions • To decide the Policies of Permits at Regional level as per directions of State Transport Authority and to delegate powers to Regional Transport Officer. Govt. Quarters Allotment Committee : As per Public Works Department Manual Rule 379 Appendix 33, the Government Quarters are allotted by Govt. Quarters Allotment Committee. In order to have proper co-ordination between committee members for allotment of Govt. Quarters for District Accommodation Allotment Committee and Accommodation Allotment Committee of Municipal Corporation places like Pune, Nagpur, Nashik, Aurangabad and Amravati. The reconstruction of above mentioned both committees has been proposed as per Public Works Department Resolution No. ACD 1084/3900 CR 109/M2/ Mantralaya Mumbai 400032 dt.25th January 1989. For demand of Govt. Quarters, the concern persons should submit the application in the prescribed Form through head of the Department to the Member Secretary of Committee i.e. Executive Engineer, P.W.Division. The Waiting list is prepared as per pay scale and date of application, as per the Govt. Resolution for allotment of Govt. quarters to Back ward class servants is also considered. The allotment is done as per guidelines laid vide Govt. Resolution dt. 02-06-2004. In case of transfer of occupant of Govt. Quarters to out of head quarter, or retirement or accidental death, the allotted quarters is vacated as per Govt. Resolution GAD/Govt.Quarter Allotment/1095/PK 807-95/23 – A Mantralaya Mumbai-400032 dt. 10-09-1996. |
